No prison time for dad who posted photo of duct-taped toddler

The Chicago man, who posted a Facebook photo showing his young daughter bound and gagged, is sentenced to probation after a Cook County judge has a change of heart.

Andre Curry was sentenced to 18 months of probation, Friday. He will also have to take parenting classes. In November, Cook County Judge Lawrence Flood found Curry guilty of aggravated domestic battery and aggravated battery – both felonies – carrying a sentence of up to seven years in prison.

Curry’s attorney, Sam Adam, Jr., filed a motion asking the judge to reconsider, arguing Curry had not obstructed the child’s breathing and did not try to strangle her.

In a rare reversal, the judge agreed and reduced Curry’s conviction to misdemeanor domestic battery.

“From the bottom of my heart, I am very sorry for all of the pain I put everyone through,” said Curry, after the hearing.
